Choosing an Attorney for Brain Injury Litigation

Just as the brain is complex, the litigation about an injury to the brain is complex and requires great skill.  These types of cases will be full of medical expert testimony as well as other relevant testimony to determine the cause of the injury, the results of the injury, and how the person is impacted by these results.

 

An experienced attorney is needed to handle the complex medical testimony that will be at the heart of the case.  Both the plaintiff's attorney and the defendant's attorney or attorneys will call medical experts to the stand.  It is important that the attorney handling your case understands enough medical terminology especially about the brain to handle the case properly.

 

It is also important to know is how these injuries will impact the person, including their ability to earn a living and live a "normal" life.  These types of issues directly impact the award portion of the trial.  An attorney has to first show that there was a brain injury and that the injury has harmed the plaintiff.  Next they have to show the nature and extent of that harm, including how severely their earning capacity may have been impacted as well as other aspects of their life.

 

Typically insurance experts that do complex analysis of the value of someone's life can be brought into the case to help ascertain (or argue against) the damages that have resulted from the brain injury.  This portion of the trial is just as complex and as important as establishing the injury.  Anyone who has suffered from a brain injury should be represented by an experienced lawyer who has handled these types of cases in the past.
